Abstract EN

The idea of the assumption of error in the administrative domain, is one of the new conception in the administrative responsibility with become adopted by the comparative legislations, mediates the notion of the error, which must be proved as basis for the establishment of the responsibility without any mistake or error, that’s why the research in this subject try to shed a highlighting on the responsibility based of the assumed error in the administrative domain .a few of the comparative study in Arabic legislations ,according to a plan of the determination of the assumed error witch help us to make decision about the basis of the responsibility in the administrative domain, in the other side, the legal basis on witch it was established(the responsibility of assumed error on the public works, or arising from the medical errors at the level of the public facility).
