Consent is the basic element of the contract, it is necessary not only for the formation of the medical contract but also for the performance of the contract.
The doctor has an obligation not to perform any medical procedure without the patient's prior consent.
The validity of consent is based on the understanding of the information transmitted and the lack of consent is understood as the lack of respect for the person of the patient of his dignity and physical integrity.
Thus, the dignity of the human being requires prior consent to any intervention.
However, the need for patient consent sometimes becomes unnecessary.

Le consentement est l'élément de base du contrat, il est nécessaire non seulement pour la formation du contrat médical mais encore pour l'exécution du contrat.
Le médecin a l'obligation de ne pratiquer aucun acte médical sans l'assentiment préalable du malade.
La validité du consentement repose sur la compréhension des informations transmis et le défaut de consentement est entendu comme le défaut de respect de la personne du malade de sa dignité et de son intégrité physique.
Ainsi, la dignité de l'être humain postule un consentement préalable à toute intervention.
Pourtant, la nécessité du consentement du patient devient parfois superflue.
