Economic, social and cultural rights are widely recognized in the majority of global and regional charters and national constitutions of countries as they represent an important part of the human rights system, and this recognition raises realistic and legal sharp controversy in terms of the justiciability of these rights.

While one trend sees economic, social and cultural rights as just programmatic goals that are implemented gradually within the limits of the resources available to each state, and therefore do not give any possibility of litigation before global, regional and national judicial and quasi-judicial bodies, at the same time there is another aspect that today receives increasing acceptance that refuses to exclude these rights of the possibility of litigation
