Shipping or (sea transport) is one of the most effective devices of commercial communication between Countries, due to its certain advantages, and its importance has increased as a result of the development of sailing traffic, as well as the great development of ships as a result of their high capacity and modern equipment.

However, the volume of disputes arising from the carriage of goods by sea has increased owing to the increased movement of trade between different Countries.

Accordingly, the topic comes to address the legal issues that arise in connection with the performance of the contract of carriage by sea between its parties, namely the carrier, the owner of the ship, and the carriage may be the charterer of the ship, the shipper and the consignee.

A number of legal problems may arise in the course of execution and are brought to justice by way of a judicial proceeding, in which defenses, whether formal or objective, are raised.
