شهادة المرأة على عقد الزواج : دراسة فقهية قانونية مقارنة

Abstract EN

This study is entitled “Woman’s Testimony on the Marriage Contract”.

It aims at presenting the opinions of the jurists regarding the woman’s testimony on the marriage contract and showing their evidence thereon, after that, the study presented the most correct opinion based on a plethora of sharia (legal) evidence.

The study introduced the opinion of the most prominent Arab personal status laws on the issue.

To achieve the objectives of this research, the study used the inductive approach, the Deductive Approach, and the Descriptive Approach.

The study concluded that it is permissible for women to act as witness to the marriage contract, with priority for men, else, then it is permissible for women to do so separately, which has not been applied in any of the Arab personal status laws.

The study recommended the necessity of re-extrapolating the views of the jurists and lawmakers on the issue for more correctness and accuracy.
