Abstract EN

The aim of this study is to clarify the legal texts that regulate the provisions of the missing in the Jordanian Personal Status Law No.

15 of 2019, taken from the views of Islamic Sharia scholars, and the impact of modern means of communication on the judgment of the death of the missing, through defining the missing, clarifying the provisions related to the missing, and the views of the scholars in the period after which the death of the missing is judged, the position of the Jordanian legislator, and the role of modern communication means in revealing the death of the missing, and its impact on the judgment of his death.

The study found that the legal texts which regulate the provisions of the missing in Jordanian law do not correspond to the development that accompanied the modern communication means, which have become able to know the life or death of the missing.

Therefore, this study calls on the Jordanian legislator to intervene to avoid this deficiency and carry out legislative reform in these texts in such a way that catches up with the development in modern means of communication.

The Descriptive-Analytical Approach, as well as the Comparative Approach, were used.

The study was divided into four sections: First: Definition of the missing and the provisions therewith, second: The period after which the death of the missing is judged and the effect of communication means thereon, third: The implications of the missing life emergence
