Abstract EN

The waqf aims at entailing the asset of funds and dedicating the earnings and yield, so in order to ensure the permanence, the waqf requires its investment to release its yield, it must be established, managed and invested within the provisions and the principles of the Islamic Sharia.

This study attempts to highlight the legal controls of the waqf investment which should match the provisions and principles of the Islamic Sharia, as first reference, by gathering the waqf provisions existing in the legal texts, connecting them to investment and referring to the Islamic law in case of lack of texts, in order to determine the most important controls that must be taken into account in the investment of waqf property.
