الأمر الجزائي فيما يخص المخالفات ورد في قانون الإجراءات الجزائية في المادة 392 مكرر و يصدر من القاضي الجزائي إلا أن إجراءاته غير مفعلة من الناحية الميدانية و التعديل الجديد بموجب الأمر 15-02 يخص إصدار الأمر الجزائي في الجنح البسيطة و التي لا تتعدي عقوبتها الحبس سنتين و إذا كانت إجراءات الأمر الجزائية هي خروج عن أصول المحاكمات العادية ينبغي أن تكون هناك ضمانات يقررها القانون لعدم انتهاك حقوق الدفاع.
Abstract EN
The criminal order in respect of offenses is set out in the Code of Criminal Procedure in article 392 bis and issued by the criminal judge.
However, its procedures are not operational in the field and the new amendment under Order 1502 concerns the issuance of a criminal order in minor offenses with no penalty of imprisonment for two years.
Penalism is an exception to the normal rules of procedure.
There should be guarantees established by law not to violate the rights of the defense.
