The obligation to rescue persons in distress at sea, without regard to their nationality, status, or the circumstances in which they found, is a long standing maritime tradition, this obligation rests with shipmasters, it is complemented by an obligation of states, to cooperate, so that persons, are disembarked in a place of safety Even when the rescue has been accomplished, problems can arise in securing the agreement of states to the disembarkation of rescued persons.

Therefore countries' refusals to allow ships to disembark passengers in their ports , as well as to prosecute shipmasters for the crime of migrant smuggling, may deter them from fulfilling their obligation of rescue.
