Constitutional control was found to preserve the principle of legality and acheieve the justice that every law desires , but in order not to ensure that the objective of laying the foundations of principle of legality does not exceed the need to ensure the stability of legal positions and respect for the acquired right of individuals,a balance had to be found between the two that preserves for each of their areas of work using it and allowing it to produce its effects and achieve its objectives.

Therefore, we have tried through research, to highlight the role of the constitutional judiciary in protecting legal security, by balancing legal security and the principle of retroactivity of the effect of an unconstitutional rule, stability of their legal positions.
