Abstract EN

The research deals with the issue of establishing lineage based on the hereditary genetic imprint, and the extent of its legitimacy in Islamic Fiqh and Tunisian positive law.

It also deals with the authority of the genetic fingerprint in establishing lineage.

The research presents the legal concept of lineage, on which a set of rights and duties are based on parents and children, and the concept resembles to what the law sees.

Whereas, while the law recognizes biological parenthood and considers it a reason to assign the title to the child, it does not consider it a lineage, because biological parenthood alone remains an imperfect relationship in both moral terms, due to the absence of legitimacy, both morally and financially, through depriving the illegitimate child of inheritance
