The judiciary has the power to stop the arbitrariness of public administration, annulling its decisions that violate laws and deny individuals the enjoyment of their rights.

However, for the judiciary to perform its function it may take time due to the length of the judicial work process between research and investigation, we find that the administration enjoys privileges over individuals, which puts endanger their situation, For this reason, the administrative judicial power has applied a separate legal mechanism, which preserves, in an urgent and temporary manner, the stability of the status of individuals vis-à-vis the authority of the administration until a final judicial decision is rendered, which establishes the right of one of the parties in dispute, which is the mechanism for stopping the execution, the latter which was taken by the Algerian legislator and administrative justice, which we will study.
