Abstract EN

The research aims to answer the following questions: 1.are the Islamic legitimate evidences leads towards definite knowledge? or it is limited to get the level of assumption (Zann)? 2.is it permissible for a Muslim to act upon assumption (Zann)? or it is a mandatory seeking definite knowledge avoiding act upon assumption? 3.if acting upon assumption is permissible, is it permissible in all matters? or it is permissible in certain matters not all? research plan : research consists from the following items: the introduction includes research plan and methodology.

the background includes perception reality and levels.

then, two topics are presented.

the first topic discusses assumption origin and its place in Islamic legitimate deduction.

six assumption (Zann) matters are discussed including assumption (Zann) reality, its uses within the Islamic legitimate text, and reasons for mentioning the assumption (Zann) within Islamic hearing evidences.

also, author explains the roots of permitting the deduction based on assumptions (Zann) in the Islamic legitimate and he defines the subject-matter of the dispute.

finally, the author concludes with weighting the opinions.

the second topic discusses examples of applications of the rule.

two matters are presented: fundamentalist applications and Islamic jurisprudence applications.

the research is concluded by a conclusion summarizing the main results and recommendations.

research methodology: author follows the critical analytical descriptive approach based on presenting the matter description and analyzing the problem.

then, available opinions were criticized to conclude the correct one with the evidence.

research results: thanks are due to Allah who ease the research means to reach many results.

here the main results are highlighted: •assumption is defined as the deduction through suspension, relaying on suspension and act accordingly.

•in Arabic language, the assumption (Zann) means either definite knowledge or doubt, and both were mentioned in the legitimate text.

•in the conversation of the late jurists, the assumption (Zann) means the reasoned tendency to choose one possibility over the other.

•“deduction through assumption (Zann)” is using the suspicious evidence to deduce or negate a legitimate rule.

•the assumption (Zann) is accepted in Islamic legitimate for the masses of scholars and it is the correct choice which is supported by peremptory evidences.

•criticizing assumption in legitimate text exclusively is used for doubt, guessing and speculation.

•deduction from assumption is legitimate in the religion branch matters as well as in the religion bases too for both scientific and practical aspects.
