ان العقد هو اتفاق بين شخصين أو أكثر و من شروط صحته أن يكون وليد ارادتين حرتين سليمتين و غير مشوبتين بأي عيب يفسدهما أما اذا تعرضت الارادة لعارض جعلها تنحرف عن الغرض الذي قصدته فعلا أو تاهت عن الحقيقة أوفقدت حرية التقدير كانت ارادة غير سليمة.
و قد تطرق المشرع الجزائري الى هذه العيوب في المواد 80 الى 91 من القانون المدني و حددها في أربع عيوب و هي الغلط التدليس الاكراه و الاستغلال.
Abstract EN
The contract is an agreement between two or more people, and one of the conditions for its validity is that it be the product of two free will, sound and untainted by any defect that would spoil them.
The Algerian legislator addressed these defects in Articles 80 to 91 of the Civil Code and identified them in four defects, namely error, fraud, coercion and exploitation.
