In the study, we dealt with the subject of proving smart contracts, as it is one of the most important topics that had a great impact on the development of the rules of evidence, and its promotion in line with the scientific and technological development witnessed by modern means of communication, by researching the authenticity of electronic writing and electronic signature, which They aim as a primary objective in proving the smart contract, Thus, the current study was limited to the definition of electronic writing from various legal and jurisprudential points of view, as well as the rooting in the statement of its authority in proving smart contracts, and to addressing the concept of electronic signature and its conditions, and the statement of its authority in proving this contract, in order to reach their probative value As evidence recognized by most legal legislation in general, and the Algerian legislator in particular, because of their role in achieving confidence and safety.
