Abstract EN

God made an exit for those who have been victims of marital infidelity and who did not have four witnesses to testify of the adultery of his wife ; this exit is the anathema.

there are several effects with regard to the latter, including : direct effects which are : the lifting of the penalty for the spouses, the separation between them, the prohibition of their reunion, and the banishment of the parentage of the child to husband.

it should be noted that the Algerian legislator did not regulate this subject ; it suffices just to mention the anathema in articles 41 and 138 of the family code, provided that the rest of its provisions are taken from sharia ; apply the reference provided for in article 222 of the same law.

but the work with dismissal here is difficult ; because sharia scholars disagree in many details of the anathema.
