تعد نظرية الظروف الطارئة إحدى أبرز النظريات التي ابتكرها مجلس الدولة الفرنسي بهدف إعادة التوازن المالي للعقد الإداري و الحفاظ على حقوق المتعاقد مع جهة الإدارة، فقد يحدث أن تعتري عملية تنفيذ العقد الإداري عوارض طارئة تكون مستقلة عن أطرافه و غير متوقعة لحظة إبرامه يكون من شأنها أن تجعل عملية تنفيذه مرهقة للغاية و أكثر كلفة، كما أنها و في المقابل لا تؤدي إلى استحالة تنفيذه، و إنما يترتب عنها زيادة في الأعباء التي تقع على عاتق المتعاقد مع جهة الإدارة، بما يتيح للمتعاقد الحق في الحصول على مساعدة من قبل جهة الإدارة لمواجهة الظرف الطارئ الذي ألم به للاستمرار في تنفيذ العقد.
Abstract EN
The theory of emergency conditions is one of the most prominent theories called on the French state council with a view to restoring the financial contract and the conservation of contracting rights with the administration.
the process is very stressful and more expensive, and in contrast, it does not lead to impossibility, but has an increase in the burden on the contractor with the administration, giving the contractor to help with the administration's assistance to address the emergency envelope, and continue to implement the contract.
