The economic view of startup cannot achieve its goal of building a strong national economy without this noble goal accompanied by a legal system that keeps pace with the modernization of commercial activity in all its dimensions, including entrepreneurship.

The startup appeared as a legal entity completely different from small and medium enterprises and from the classic forms of commercial companies because they are based on the ideas of establishment and rapid growth as well as their creative nature and their risk tolerance, which raised legal problems in the field, and the Algerian legislator has not yet decided on it, especially in terms of concept and legal nature and the necessity of Achieving harmony between texts.

There fore, This study came to clarify this link between the economy and the law, as it aims to show the legislative shortcomings in the field of startups companies on the one hand, and the inconsistency of the legal texts regulating them and those regulating micro, small and medium enterprises on the other hand.
