Abstract EN

This paper aims to explore the extent to which transparency is promoted in concluding public service delegation contracts and to highlight the extent to which executive decree 18-199, as a procedural regulation, contains provisions to shift the transparency of public service delegation procedures from regulation to empowerment, as well as to address its exceptions under the administrative and judicial guarantees enshrining the principle of transparency.

The executive decree 18-199 sought to provide transparency in the methods and procedures for concluding public service contracts by, on the one hand, devoting announcement and publicity and, on the other hand, creating internal and external administrative guarantees, as well as the role of emergency jurisdiction in giving judicial protection to the principle.
