The research aims to define the concept of arbitration for the settlement of disputes of administrative contracts, to indicate its legal nature and the position of the legislator, jurisprudence and administrative judiciary, and to determine the terms of the validity of the arbitration agreement to settle disputes of administrative contracts and the implications of arbitration, and the results of the research are that the effectiveness of arbitration as an alternative exceptional system of litigation is linked to the extent to which arbitration provisions of the arbitrators are adhered to, since arbitration judgements, although they hold the authority of the expired object, lose their value in the event of failure to implement, especially for countries.
