تعد التدابير الوقتية والتحفظية السبيل الوحيد لحفظ الحقوق المهددة بالخطر، وبالرغم من أهميتها إلا أنه لم يتم الفصل في الجهة التي تملك صلاحية إصدارها، في المسائل المتفق بشأنها على التحكيم كما أن التشريع والفقه لم يعالج جميع المسائل المتعلقة بها، خاصة فيما يتعلق بمسألة تنفيذها وأرجع العديد من المسائل المرتبطة بها للقواعد العامة، بالرغم من طبيعتها الخاصة التي يميزها طابع الاستعجال.
Abstract EN
Temporary and provisional measures are the only way to preserve rights at risk although they are important, the authority to issue them has not been adjudicated on issues agreed upon for arbitration, legislation and jurisprudence have not addressed all issues relating to them particularly on the question of their implementation.
