تعرض التقسيم الثنائي للمسؤولية المدنية للعديد من الهزات العنيفة منذ القدم بداية من الانتقادات القوية له من طرف الفقه الكلاسيكي التي تزداد قوة حجيتها من يوم لآخر مرورا بالتطبيقات القضائية الحديثة التي جسدت العلاقة التبادلية بين المسؤوليتين و شكلت خرقا واضحا لمبدأ عدم الجمع بين المسؤوليتين وصولا لخروج بعض التشريعات الحديثة عن هذا التمييز بسبب خصوصية المسؤولية المهنية التي صعبت من مهمة القاضي في إخضاعها للتمييز.
لذا فإن هذا البحث يهدف لتحليل تأثير المستجدات القانونية على التمييز بين المسؤوليتين التقصيرية و العقدية الذي استقرت عليه جميع التشريعات و تبيان كيفية مساهمتها في إضعاف التجسيد الفعلي للحدود الفاصلة بين المسؤوليتين
Abstract EN
The bilateral division of civil liability has been subject to many violent shocks since antiquity, beginning with strong criticism by classical jurisprudence Which grows stronger from day to day, from modern judicial applications that embodied the reciprocal relation between the two responsibilities, and constituted a clear violation to the precept of not combining the two responsibilities, to the departure of some modern legislation from this discrimination, due to the specificity of professional responsibility that made it difficult for the judge to subject it to discrimination.
