Abstract EN

This study aims to determine the criminal responsibility resulting from the transmission of the Covid-19 (Corona virus), since maintaining public health means combating all safety threats that threaten people's lives, The study focuses on the legal consequences of transmitting the Coronavirus, in addition to the position of Islamic Sharia on everything necessary to save one of its five main purposes, which is self-preservation.

The problem of the study justifies the adequacy of the applicable laws in determining criminal responsibility for transmitting Coronavirus infection.

To achieve the main objective of the study, the study used the comparative analytical method through the analysis of Palestinian legal texts, comparative Arab laws and Islamic law.

The study concluded with a set of results and recommendations, the most important of which are: Individuals' criminal responsibility for transmitting the Coronavirus is investigated in the event that orders and instructions are violated, and not adhering to the legal procedures and controls issued by officials and specialists.

Also the Palestinian Penal Code has become outdated and not in line with the requirements of the age, as it needs to be amended in some of its texts.

The study recommends the necessity of issuing a law resolution that addresses the legislative deficiency in laws related to emerging infectious diseases, and we also recommend the necessity of imposing strict measures and more deterrent penalties to limit the spread of the Coronavirus.
