Arabic Abstract

تناولت هذه الدراسة مفهوم الإلزام من الجانب النظري عند الأصوليين، والمناطقة، والجدليين، وفي آداب البحث والمناظرة حيث تبين استعماله كأداة حجاجية في العلوم النظرية، والرد على الخصوم في تحرير المقالات، وتصويب الفهوم، وتوكيد مراعاة التوافق بين الأصول والفروع دون تناقض ولا تحكم، وأنَّ الإلزام مركوز في طباع الباحثين، وأنجع وسيلة لتحقيق المراد، وأما في الجانب التطبيقي، فقد تحرر في الدراسة استعمال الشافعي للإلزام في تثبيت مصادر التشريع، أو توكيد بعض مباحثها في رده على مخالفيه، كخبر الأحاد، والقياس، والإجماع، والاستحسان، ودلالة النص.

English Abstract

This study dealt with the concept of compulion from the theoretical side of the fundamentalists, logicals, and dialectics and in etiquette of research and debate, were it was used as a pilgrimage tool in theoretical sciences, and deterring opponents in editing articles.

Correcting the concept, and affirming the observance of the compatibility between the principles and branches without contradiction or control, and that the obligation in concentrate in the nature of the researchers and the most effective way to achieve the desired and in the applied aspect.

The study has liberated the use of Al-Shafii for the obligation to confirm the sources of legislation or the assertion of some principles urged in response to the violators, as news sundays, measurement, and consensus, and approvingly, and the significance of the text.
