The Iraqi legislator included special provisions for the incompetent in the civil procedure code in terms of the discriminatory appeal mechanism, by making it a duty on the court, in a way that leads to refraining from implementing the judgment unless you distinguish it in order to achieve the purpose and will of the Iraqi legislator represented in achieving the interest of these people; but the judiciary restricted the provisions included in the text, and made them limited to issues related to marriage, and the issues related to the solution and sanctity, on its count as principles of public order without focusing on the interests of the incompetent.
