Abstract EN

This study aims to identify the essential features of the constitutional amendment of 2020, and to determine the content of the new constitutional provisions.

The study concluded that the emergence of new trends of the Algerian constitutional founder towards the adoption of the theory of Fundamental Rights, which further improved the Fundamental constitutional rights, worked to stabilize the relationship between the executive and legislative branches within the limits of cooperation and balance, and established the right of participation of the parliamentary majority in the formation of the government and the implementation of its program.

This constitutional amendment maintained the duality of executive branch without affecting the nature of the political system prevailing before the amendment.

And the constitutional founder created a constitutional court, which was considered an independent institution entrusted with several competencies, including the oversight of constitutionality in Algeria.
