تناولنا في هذه الدراسة إشكالية تناول المشرع الجزائري لعقد تفويض المرفق العام في المرسوم الرئاسي رقم 15 / 247 في نص معظم أحكامه تتعلق بالصفقات العمومية.
واستخلصنا أن هناك اختلافات جوهرية بين العقدين، ومع ذلك فهما آليتين قانونيتين قد تستعملهما السلطات العامة إذا رغبت في الاستعانة بالغير عند قيامها بأداء الخدمات والأشغال العامة وتسيير المرافق العامة.

it has concluded, that there are the essential differences between the two contracts, although they remain legal mechanisms that the public authorities use in their mission of public service.
