Arabic Abstract

جاءت هذه الدراسة تتناول موضوع الشفعة في المال المنقول، فوجدنا ان القانون الاردني لم يقصر الشفعة على العقار فقط بل اخذ بالمنقول الا ان المشرع الاردني لم ينظم بعد المنقول بنصوص واضحة و لم يفرد للمنقول قوانين خاصة كما هو في العقار على رغم ما لها من اهمية واسعة و اثار عملية متعددة و هامة في التطبيقات القانونية.

و خلصت الدراسة إلى مجموعة من النتائج من أهمها : إن الشفعة في المال المنقول تقسم إلى أربعة أنواع، النوع الأول : المنقول بطبيعته، و النوع الثاني المنقول بحسب المآل، و النوع الثالث المنقولات المادية، و النوع الرابع المنقولات المعنوية و لكل من هذه الانواع تطبيقاتها و احكامها، و بسبب ضرورات الحياة و تطوراتها من حيث تداول الأموال و سرعة دوران الحياة الاقتصادية و التجارية و الاجتماعية توجب علينا وضع النصوص التي تساير تلك التطورات.

و أما أهم التوصيات التي خرجت بها الدراسة فهي ضرورة تعديل و تطوير النصوص القانونية التي تساير الحياة و منها موضوع الشفعة في المال المنقول، حيث أصبح واجبا : على المشرع الأردني أن ينظم أحكام هذا الموضوع في فصل مستقل مثلما فعل المشرع المصري عندما أفرد للشفعة أحكامها الخاصة.

English Abstract

This study is concerned with preemption in the movable property, and we found that the Jordanian law did not limit the preemption on the property only, but took the movable, and the Jordanian legislator has not yet regulated movable clear texts and did not specify the movable special laws as it is in the real estate despite the importance and wide impact of the multiple and important process in legal applications.

The study concluded with a series of results, the most important of which are : Preferring in the movable property is divided into four types : Type I : natural movable, Type II money movable, Type III materialistic movable, Type IV incorporeal movable.

Each of these types have an applications and provisions, because of the necessities of life and developments in terms of circulation of funds and the rapid turnover of economic, commercial and social life, we have to develop texts that correspond to those developments.

The study reached recommendations, the most important of which are : the need to amend and develop legal texts that are in keeping with life, including the topic of the preemption in the movable property, since it became obligatory for the Jordanian legislator to regulate the provisions of this topic in a separate chapter as the Egyptian legislator when he singled out its special provisions.
