الكونية و العالمية هي الأصل التقعيدي لثقافة الحق، على قاعدة اتصاله بالعلة المصدرية التي تقعد للعالمية و الوحدة، و التي أخذت عبر التاريخ الثقافي صورا عدة، فالطبيعة و الله هما المحور الذي تقيم عليه الثقافات تأصيلها للحق، فالديانات باعتقاده في الله كوحدة وعلة مشتركة للجميع، تجعل من التشريع ناموسا كليا لفلسفة الحق، و العقلانية الحداثية بثورتها على التدين تضع الفطرة و الطبيعة مبدا لجميع القواعد الناظمة للحق، و لحظة اللقاء تكون في المطلبية التي هي العدالة، المطلب الرئيس في الحياة البشرية، و المسألة تبدا في التعارض الموجود بين السنن البشرية في التقعيد للحق، و الأنسنة للحق تستلزم تمدينه بصور و صيغ مجتمعية و ابعاد رهطية، فيصبح التعدد و الاختلاف علامة مميزة لفلسفة الحق.
وعليه نروم من البحث التعرض لأهم الاشكالات المدنية والمواطنية و التي تعيق كونية الحق من خلال مبحثين: الاول المتعلق بالمطلقية، من إعداد الباحث شريف الدين من شعبة الفلسفة، و الثاني حول نسبية الحق و تقديم الباحث عبد الكريم تبون من كلية الحقوق بجامعة سعيدة، و القصد هو التعاطي مع المسألة من زاويتين لارتباط الحق بالفلسفة و القانون معا
Abstract EN
Religion is considered as the first source of human knowledge, and after it comes culture to grant the rights and the rules on which a historical legitimacy is based, which man will be unable in the future to act and amend them, and even the new terminology of the rights has become positive rights.
Accordingly, the truth fell into the symbolism of the balance, the standard of olutism, whose banner bore religion, philosophy and the standard of positive law.
This study aims to research from two angles: For the first one in which the researcher investigates the doctrinal and philosophical foundations that establish the universality of the right, and the second in which the professor of law reads the relativity that accompanies the idea of the right through the constitutional codes and legal texts
