Criminals have become dependent on technical means to commit the crime of irregular immigration, and this is what makes it difficult for them to be detected by judicial authorities based on traditional investigative methods, hence the need for lawmakers to activate the system of research and investigation of this dangerous transnational crime offense, strengthening the powers of the judicial police and allowing them to use special investigative techniques, which it had introduced in accordance with Law n° 06-22, amending and supplementing the law on criminal procedure, these new methods are represented in electronic monitoring and field monitoring.

This study aims to determine the nature of the methods that the legislator has developed within the framework of this law to activate the process of investigating this crime and to determine the conditions for its implementation.
