The légal determination of the age of marriage, even if it is within the framework of the Legal Policy, which allows the legislator to intervene to limit what is permitted in order to guarantee the interest of young people and the protection of society.

With the possibility of an age waiver in response to the requests of certain groups living in special circumstances, not orbed by the legal age, and allowing them to complete the marriage authentically, under the authority and control of the competent judge.

However, the study proved that this determination causes many legal and judicial problems, including the prevalence of customary marriage of minors sometimes in need of money and sometimes scandal.

As well as the exemption from marriage granted by the judge on an exceptional basis concerned the availability of interests or the necessity, without determining the minimum age for the exemption, or taking into consideration the age differences between the spouses.

And the ence of the legal text which Sanctions the marriage without dispensation of age.
