حدد المرسوم الرئاسي 15 / 247 طرق وإجراءات إبرام الصفقات العمومية، وفقا لإجراء طلب العروض الذي يعد الأصل العام لإبرام الصفقات، إلا انه أورد عليه استثناءات يجوز من خلالها للمصلحة المتعاقدة أن تبرم صفقاتها دون التقيد بالإجراءات الشكلية والموضوعية التي يتطلبها القانون، إلا أن ذلك لا يعني السماح لها باختيار المتعامل عشوائيا، بل إخضاعها المرسوم 15 / 247 لجملة من الشروط والإجراءات حددت أحكامها على سبيل الحصر في نصوص المواد 49، 51 من ذات المرسوم، بما يضمن الشفافية في إبرام هذا النوع من الصفقات سعيا محاربة الفساد الذي يطال هذا النوع من التعاقد.
Abstract EN
The presidential decree no 15 / 247 established the methods and procedures for concluding public transactions, in accordance with the procedure for requesting proposals.
however, he has been provided with exceptions through which the contracting interest may be permitted conclude their deals without being bound the formalities and objectivity required by law.
nevertheless, that does not mean allowing them to randomly select the operator as it was subject to a set of conditions and procedures.
the latter, were limited to its provisionsin the texts of articles 49.51 of the same decree, ensuring transparency in the conclusion of this type of transaction, in order to fight corruption that extends this kind of contract.
