One of the most important legal principles recognized in all laws is that the accused is innocent until proven guilty and must therefore be dealt with on the basis of the presumption of innocence assumed during the investigation process, through the provision of legal guarantees guaranteeing the protection of his material and moral rights.

Algeria, as a member of the international community, has ratified numerous human rights instruments and treaties, which have been enshrined in its domestic law by separating the work of the investigating judge from that of the prosecutor and by bringing judicial discipline under his control during the investigation phase, while monitoring the work of the investigating judge through the indictment chamber and making some of his actions subject to appeal.
