counterfeit drugs is considered one of the phenomena which have become an economic threat to pharmaceutical industries, it also comprises consumers safety, which may lead to adverse health consequences, therefore, numerous countries have proceeded to fighting this phenomenon through putting legislation in place and put an end to this phenomenon.

These legislations were initially focused on protecting pharmaceutical companies' rights and their products from counterfeiting, to gradually develop in order to ensure consumers protection from counterfeiting and the state's economy as well.

The Algerian legislation had kept pace with this development, through the promulgation of the health act N: 18 -11 which included legal measures that would guarantee pharmaceutical drugs protection from counterfeiting, and aim as well to protect medicines consumers, their producers and the national economy as a whole.
