Abstract EN

This study aims to shed light on the alternative measures for detention, especially in light of the spread of the Covid – 19 Pandemics, to determine the possibility of applying alternative measures for detention.

The researchers used the descriptive, analytical, approach.

The study includes a statement of what alternative measures are for arrest and the Corona pandemic, the alternative measures in Palestinian legislation and comparative legislation, and finally, the flaws in the application of alternative measures to arrest in the light of reality.

The study reached several results, the most important of which is that detention is an investigative procedure and results in the deprivation of the freedom of the accused for a certain period, and therefore there is an urgent need to apply alternative measures to spare detainees the disadvantages of detention, especially in light of the spread of the Corona pandemic.

Among the most important recommendations of the study is the necessity of applying alternative measures to detention and working to find solutions to the obstacles that prevent their application on the ground, including sparing detainees’ personal and health risks, especially in light of the spread of the Corona pandemic.
