تعتبر عقوبة الإعدام من أهم العقوبات المقررة لأخطر الجرائم و أكثرها جسامة و ضررا في التشريع الجزائري و التشريعات المقارنة، حيث يفضي تطبيقها إلى إنهاء حياة المحكوم عليه.
لذا فهي كانت و ما زالت محلا للجدل الفقهي حول مدى نجاعتها أو تناسبها مع جسامة الجريمة المعاقب عليها بها من عدمه.
وفي عام 1993 ألغت الجزائر تنفيذ حكم الإعدام و هو ساري المفعول إلى اليوم.
و الآن أصبح رفع التجميد على تنفيذ عقوبة الإعدام ضروريا خصوصا على جرائم اختطاف الأطفال و الاعتداء عليهم، لأن جميع العقوبات الآنفة لنم تعد تجدي نفعا
Abstract EN
The death penalty is one of the most serious and harmful penalties established for the most serious and harmful crimes in Algerian legislation and comparable legislation, the application of which results in the termination of the life of the sentenced person.
So it was, and continues to be, the subject of doctrinal debate as to whether or not it was effective or appropriate to the gravity of the crime for which it was punishable.
In 1993, Algeria abolished the execution, which is now in force.
It is now necessary to lift the freeze on the execution of the death penalty, especially for the crimes of abduction and abuse of children, since all the aforementioned penalties are considered to be useful
