Since independence, the Algerian legislator seeks to regulate the urban domain through adjusting real estate evidentiary bonds and using many legal mechanisms the most important of them are construction contracts.

These contracts are divided into two types; some of them are prior to construction and others are after it.

They are considered preventive, deterrent and protective mechanisms with regard to real estate properties.

Therefore, respecting or violating these reconstruction bonds affects judicial protection because of the close relation between real estate evidentiary bonds, construction contracts and legal protection.

However, the implementation of construction contracts on the ground has been encountered by various difficulties and problems which has served as an inciting cause of trickery by some people by dividing lands and constructing buildings in violation of the law.

This led to problems and complex judicial disputes even, if, they are decided by a final ruling, practically, they raised problems in their implementations.

This has negatively affected the protection of real estate and the spread of chaotic buildings.

Therefore, this study came to shed light on the construction contracts as a mechanism to protect real property.
