According to Law 15-02, the Algerian legislator created the penal order system to simplify the procedures for judging minor offenses.

It aims to end a public trial without following the usual investigative and judgment procedures necessary for the pronouncement of criminal judgments and the guarantees and rights legally established for them.

And he has authorized a right of opposition against these orders during a period determined by the law, in order to protect these rights, and by following specific procedures which differ from the usual procedures in case of appeal, to return to the guarantees of a fair trial in favor of the accused, this right of opposition is accorded only to the Public Prosecution and the accused.
