أدى التطور في مواقع التواصل الاجتماعي إلى زيادة الاهتمام بالخصوصية الرقمية للأفراد والتي أصبحت تمثل هاجسا لكثير منهم، وذلك نظرا للإمكانيات الكبيرة للمنصات الرقمية ومواقع التواصل الاجتماعي في جمع ومعالجة وتحليل وتخزين المعلومات الشخصية، وهذا ما دفع بالمشرعين وأصحاب القرار إلى ضرورة توفير القوانين الكافية لحمايتها، ونسعى من خلال هذا البحث إلى تسليط الضوء على الحق في الخصوصية الرقمية، وعلى أهم السبل المتوفرة من أجل حمايته، وأيضا على أهم معوقات حماية هذا الحق.
وخلصنا إلى أنه رغم وجود عدة جهود تشريعية على المستوى المحلي والدولي من أجل حماية الحق في الخصوصية الرقمية، إلا أن هناك عدة عوامل تحول دون الحماية الكاملة لهذا الحق، مما يستوجب مضاعفة الجهود وتظافرها بغية الوصول إلى حماية أفضل وشفافية أكبر حول استخدام المعلومات الشخصية.
Abstract EN
The development of social media has led to an increased interest in the digital privacy of individuals, which has become a concern for many of them, and through this research, we seek to highlight the right to digital privacy, the most important means available for its protection, as well as the most important impediments to its protection.
we have concluded that, although there are several legislative efforts to protect the right to digital privacy, there are several factors that prevent the full protection of this right, which requires that efforts be stepped up and demonstrated in order to achieve better protection and greater transparency about the use of personal information.
