The intensity of hate speech has recently escalated due to the development of mass media and communication ; in particular the internet, at both the international and national levels.

religions, sects, and their sybols have been the target of several abuses.

foreigners, including immigrants and refugees, have been rejected to the extent of using violence against them.

although this phenomenon is alien to Algerian society, compared to other societies, the latter has emerged more with the hirak.

popular uprising, and after it ; there fore, the present study aims to define this discourse accurately from a legal point of view, and monitor the most important mechanisms to combat it both internationally and nationally.

by stating so, the researcher's objective is to distinguish between what is considered hate speech and what is not within the framework of criminalization and punishment, and, there fore, the need to address to the aforementioned phenomenon by all means except legal ones.

the present study uses both descriptive analytical and the comparative methods.
