تحظى عملية اختيار و تنصيب رئيس المجلس الشعبي البلدي بأهمية كبيرة في النظام القانوني الجزائري، و تعود تلك الأهمية اعتبارا للدور الهام الذي تقوم به البلدية في دفع عجلة التنمية و التكفل بانشغالات المواطنين باعتبارها الحلقة الأقرب لهم من جهة، و كونها الصورة الأمثل لتجسيد اللامركزية كخيار تم اعتماده لتسيير الشؤون المحلية من جهة أخرى، إضافة إلى المركز القانوني الذي يميز رئيس المجلس الشعبي البلدي، و عليه و أمام الإصلاحات السياسية و القانونية التي تم اعتمادها في الجزائر بعد أحداث 22 فيفري ،2019 و ما تبعها من تداعيات تأتي في مقدمتها تعديل الدستور، و اعتماد قانون عضوي جديد للانتخابات، و الذي اعتمد بموجبه المشرع الجزائري نظام القائمة المفتوحة، كان لزاما تعديل بعض أحكام القانون رقم 11-10 المتعلق بالبلدية التي لها علاقة بكيفية اختيار و تنصيب رئيس المجلس الشعبي البلدي، و هو ما تم بموجب الأمر رقم 21-13 المؤرخ في 31 أوت 2021 لمواكبة تلك التغيرات.
Abstract EN
The selection and inauguration process of the president of the people's municipal assembly is of great importance in the Algerian legal system.
that importance is due to the significant role of the municipality in advancing development and ensuring citizens' concerns as the nearest link, on the one hand, and the optimum image of decentralization as an option for the conduct of local affairs, in addition to the legal status of the president of the people's municipal assembly.
accordingly, given the political and legal reforms adopted in Algeria after the events of 22 February 2019 and the consequences thereof, the first of which was to amend the constitution and adopt a new organic law for elections, by which the Algerian legislature adopted the open list system, some provisions of act no.
11-10 on the municipality had to be amended concerning the selection and inauguration of the president of the people's municipal assembly.
this was done by ordinance no.
21-13 of 31 July 2021 to keep pace with these changes.
