يهدف هذا البحث إلى توضيح موقف المشرع الجزائري من اشتراط المصلحة في عقد التأمين، بمعنى هل اشترطها في جميع أنواعه، أو اقتصرها على تأمينات الأضرار دون الأشخاص.
حيث حصر طبيعتها من خلال نص المادة 621 من القانون المدني، في المصلحة الاقتصادية التي تميز العقود الأولى دون الثانية.
إذ لاحظنا كونها معنوية في بعض عقود تأمينات الأشخاص، مما استدعى منا دراستها ضمن نوعي عقود التأمين، بتقسيم البحث إلى قسمين، كل قسم يتناول المصلحة بالتحليل و الشرح ضمن نوع من تلك العقود (عقود تأمين الأضرار و عقود تأمين الأشخاص).
و خلصنا إلى أنه و باعتبارها سببا لعقد التأمين، فالمصلحة شرط لانعقاده و استمراره.
فوجودها يمنع المؤمن له أو المستفيد من عقد التأمين من تعمد إحداث الخطر المؤمن منه، و اشتراطها يباعد بين التأمين و القمار أو الرهان، فيجب إذا توافرها ضمن نوعي عقود التأمين.
Abstract EN
This research aims to clarify the position of the Algerian legislator regarding the requirement of interest in the insurance contract.
did he stipulate it in all its forms or only on the insurance for damages? the article 621 of civil code requires the economic interest, but it is moral in some person's insurance contracts.
we concluded that the interest is the reason for the insurance contract.
it prevents the insured or the beneficiary of the insurance contract from deliberately causing the insured risk.
its requirement separates insurance from gambling or betting, so it must be available within the two types of insurance contracts (damage insurance contracts and person's insurance contracts) .
