إن علماء أصول الفقه الإسلامي استفادوا من طريقة اللغويين في الاستخدام الجيد لقرينة السياق بنوعيه و وظفوها بشكل عملي في دراستهم الخاصة و المتميزة في استنباط أحكام النصوص الشرعية، و ترجيح معانيها من خلال ما اصطلح عليه بالقواعد الأصولية اللغوية، و يتجلى بوضوح اعتمادهم على قرينة السياق في المواضيع المتصلة باعتبار دلالة اللفظ على المعنى بحسب ظہور المعنی و خفائه، كواضح الدلالة، و منه: الظاهر و النص و المفسر و المحكم، وخفي الدلالة و منه: الخفي و المشكل و المجمل و المتشابه، و كذلك باعتبار كيفية دلالته على المعنى من حيث قوة الدلالة و تفاوت مراتبها، وهي أربعة طرق: عبارة النص و إشارة النص و دلالة النص و اقتضاء النص فيرجح عند التعارض أقوى الدلالة بفضل قرينة السياق و على أساسها يؤول و يفسر الخطاب القرآني و النبوي على الوجه الصحيح المقصود و المراد معنى و حكما، و هذا ما نهدف إلي تبيينه في هذا المقال
Abstract EN
The scholars of principles of jurisprudence had benefited from the method of linguistics in dealing with the context in the extraction of judgments from the religious texts, and determination of the most likely meaning through the linguistic principles' rules, especially in the chapter of words' significations, that studies the divisions of words according to the appearance of their meanings, as well as the way of signification and its power.
Therefore the evidence of context is used to interpret the religious texts in the intended way, this is what we aim to explain through this article
