Abstract EN

The major risks and natural disasters are among the biggest constraints facing Algeria, as it is one of the countries exposed to these risks.

This prompted the Algerian legislator to review the legislative system, which relates to the field of reconstruction and preparing the region, by establishing legal mechanisms to protect the population from those risks, including the expropriation due to the high risk, for properties that are already exposed to large and permanent risks.

Despite the importance of this procedure in preserving lives and property, it remained ambiguous, due to the referral to the law related to expropriation for the purpose of public benefit with the difference between the two procedures in motives and ends, which led us to address the problems raised by this procedure, especially if we know that many of the buildings in Algeria were due to their constant exposure to risks.
