الجريمة المستحدثة هي السلوكيات الخطيرة التي تمس المصالح القيمة في المجتمع، و التي استخدمت فيها تكنولوجيا الإعلام و الاتصال بشكل واسع لأجل تسهيل عملية الإجرام، ترتبط بالتقنية، و تتميز بدقة التنفيذ و الإتقان و ترتب على وجودها تغيير جوهري لمفهوم الجريمة التقليدية و إجراءات متابعتها.
وقد تكون الجريمة المستحدثة وطنية أوعابرة للحدود، فثورة الاتصالات ساعدت على التحرر من الخصوصية الزمنية و المكانية للجريمة، و أصبح ركنها المادي يتشتت في كل بقاع العالم، مما استدعى وجود آليات دولية لمكافحة هذا النوع من الأجرام المستحدث عبر العديد من الاتفاقيات الثنائية منها و العالمية.
هذه المعطيات المستحدثة على الجريمة أدت بها إلى التأثير على النص الجنائي التقليدي
Abstract EN
New crimes are dangerous behaviors that affect valuable interests in society, in which information and communication technology has been used extensively in order to facilitate the crime process.
The new crime may be national or cross-border, as the communications revolution helped liberate the temporal and spatial specificity of the crime, and its material corner became dispersed in all parts of the world, which necessitated the existence of international mechanisms to combat this type of crime created through many bilateral and global agreements.
These updated data on the crime led to an influence on the traditional criminal text.
