Article 4 (h) of the A.U.

constitutive act limits the right of intervention to "grave circumstances".

in order to deal effectively with these circumstances, and once peaceful means have failed, the A.U.

is supposed to use force.

intervention under article 4 (h) is regarded as a right, therefore the A.U.

assembly has the power of discretion to decide in favour of intervention including military intervention without the security council authorisation.

thus this article discusses the A.U.

implementation of its decision on military intervention under article 4 (h) of the constituve act in the light of article 53 of the U.N.

charter.
