تهدف هذه الدراسة إلى محاولة تحديد دقيق لأعمال المنافسة غير المشروعة من خلال ما توفر لنا من تعاريف قضائية وقانونية وفقهية إذ يتعين علينا البحث في إيجاد تعريف مستقر لهذه السلوكيات في ظل التداخل الكبير بين المفاهيم.
وعلى اعتبارها من الجرائم الواقعة على المنافسة وارتباطها بمناخ الأعمال فقد كان من الضروري تحيدها حتى يتسنى للمشرع تجريمها.
وهي من المظاهر الهامة لهذا التطور في سياسة التجريم والعقاب في العصر الحديث.
Abstract EN
The aim of this study is to try to determine the definition of unfair competition acts through the judicial, legal and jurisprudential definitions provided to us, as we have to search to find a stable definition of these behaviors in light of the great overlap between concepts.
considering it as one of the crimes against competition and its connection to the business climate, it was necessary to neutralize it so that the legislator could criminalize it.
it is one of the important manifestations of this development in the policy of criminalization and punishment in the modern era.
