Abstract EN

Among the current jurisprudence; human cerebral death; what is its ruling under sharia law? furthermore, is it allowed to freely use human organs? this study aims to highlight the legal attitude (under sharia law) towards human cerebral death and the resulting legal rulings.

in order to conduct this study, two methods were adopted: descriptive and analytical.

the study concluded that, it is wise to inform that the death of a human cannot be decided only by the death of “the brain stem”, and it is permissible to remove the life support equipment from him / her in case of despair of his / her recovery.

however, it is allowed that the deceased could become an organ donor subject to his / her prior permission or that of his / her heirs.
