Arabic Abstract
تناولت هذه الدّراسة المسائل التي خالف فيها الإمام زُفَر شيخه أبا حنيفة في كتاب الزكاة.
و تهدف هذه الدّراسة إلى الوقوف على تلك المسائل، و جمعها في مصنف واحد، من خلال استقراء تام للمسائل من أهم المصادر و الكتب المعتمدة في المذهب الحنفي، و بيان أوجه الخلاف في المسائل، و معرفة رأي المذاهب الأربعة في المسائل، و التعرف على منهج الإمام زفر في النظر في المسائل الفقهية.
و من أبرز ما توصلت إليه هذه الدراسة الوقوف على اثنتين وعشرين مسألة خالف فيها الإمام زفر شيخه الإمام أبو حنيفة في كتاب الزكاة، منها المتعلق بالنية و منها المتعلق بجنس المال ومنها المتعلق بالنصاب و منها المتعلق بزكاة الحيوانات و منها ما هو متعلق بزكاة العُشر، و مسائل متعلقة بمصارف الزكاة، و مسائل متعلقة بزكاة الهبة.
و مسائل متعلقة بزكاة الديون و مسائل متعلقة بزكاة الفطر ثم انتهت هذه الدراسة بخاتمة اشتملت على أهم النتائج التي توصلت إليها.
English Abstract
This study addressed the controversial issues between Imam Zofar and his Sheikh Abu Hanifa in the book of charity.
The study aimed at identifying those controversial issues, collecting them in one collection by a full deduction for the issues from the most important resources and books in Al-Hanafi doctrine as well as demonstrating the facets of disagreement in the issues, identifying the opinion of the four doctrines in the issues and the approach of Imam Zofar concerning them.
The study results showed that there are twenty-two issues of disagreement between Imam Zofar and his Sheikh Abu Hanifa in the book of charity, including the issues related to intention, money origin, the minimum amount for paying charity, animals’ charity, one-tenth charity, the issues of charity channels, endowment charity, debts' charity, and Al-Fitr charity.
The study concluded with a conclusion that included the most important findings of the study.
