تعد الدولة الشخص الرئيس في القانون الدولي العام و تتحقق هذه الشخصية باجتماع ثلاثة عناصر هي الشعب و الإقليم و التنظيم السياسي، لكنها لا تستطيع أن تباشر علاقاتها الدبلوماسية مع الدول إلا من خلال الاعتراف بها، و خلال حياة الدولة ربما تضطرها الظروف إلى الاقتراض، لكن الدولة ليست أزلية بل تولد و تتطور و تزول أحيانا لذلك سنكون أمام حالتين من المتغيرات التي تصيب الدولة الأولى عند حصول التغييرات دون أن تؤثر في شخصيتها الدولية و الثانية هي التغييرات التي تطرأ على الدولة و تؤدي إلى زوال شخصيتها الدولية، و في الحالتين تترتب أثار قانونية على العديد من الظواهر التي تتعامل بها الدولة و منها ما التزمت به من قروض تجاه الغير.
Abstract EN
The state is the main person in public international law, and this personality is achieved by the meeting of three elements: the people, the region, and the political organization.
However, it cannot conduct its diplomatic relations with states except through recognition.
During the life of the state, circumstances may force it to borrow, but the state is not eternal but it is born.
It evolves and sometimes disappears, so we will be faced with two cases of variables that affect the first state when changes occur without affecting its international character, and the second is the changes that occur to the state and lead to the demise of its international personality obligated by the loans towards others.
